Employer sponsored visas provide a targeted pathway for Australian businesses to hire skilled overseas workers when they cannot find appropriately skilled local talent. For many professionals, this is a clear and structured route to permanent residency.

The transition from a temporary employer sponsored visa to a permanent one requires careful planning. Both the business (sponsor) and the employee (nominee) must meet strict Department of Home Affairs criteria at every stage of the process.

Temporary Pathway

Subclass 482 (TSS) / Skills in Demand Visa

This temporary visa allows employers to sponsor a suitably skilled worker to fill a position. The Australian Government is transitioning this visa into the new Skills in Demand (SID) program, designed to provide clearer pathways to permanent residence and greater mobility for workers.

The Three-Step Process:

  • 1. Sponsorship: The employer applies to become a Standard Business Sponsor, demonstrating they are a lawfully operating and viable business.
  • 2. Nomination: The employer nominates a position. This step involves proving a genuine need for the position, meeting the Annual Market Salary Rate (AMSR), and strictly conducting Labour Market Testing (LMT).
  • 3. Visa Application: The applicant must demonstrate they have the required skills, qualifications, work experience (usually at least 2 years), and English proficiency for the nominated occupation.

Permanent Pathway

Employer Nomination Scheme (Subclass 186)

The ENS Subclass 186 is a permanent residence visa for skilled workers. Recent policy updates have expanded the permanent residency pathways, allowing more temporary visa holders to transition to PR.

Main Streams:

  • Temporary Residence Transition (TRT) Stream: Designed for workers who currently hold a Subclass 482 (or related) visa and have worked for their employer for the required qualifying period. The employer must be willing to offer a permanent position.
  • Direct Entry (DE) Stream: Suitable for applicants who have at least three years of relevant post-qualification work experience, a positive formal skills assessment, and competent English. They can be nominated directly for permanent residency without needing to hold a 482 visa first.

Important Strategic Considerations

Employer sponsored visas are highly scrutinized by the Department of Home Affairs. Common reasons for refusal include:

  • Inadequate or incorrectly timed Labour Market Testing (LMT).
  • Failure to prove the position is “genuine” and makes economic sense for the business.
  • Discrepancies between the applicant’s duties and the official ANZSCO definition.
